VisionXtra Direct to Patient March/April promotion (“Promotion”) - Terms and Conditions

 

  1. By participating in the Promotion, you agree to be bound by these terms and conditions. Promotional materials relating to this Promotion, including all information as to how to participate, also form part of these terms and conditions. To the extent that there is any inconsistency between such promotional materials and the terms and conditions contained within this document, the terms contained within this document shall prevail.

  2. The Promotion is open to selected Independent and Regional/Local Chain CooperVision customers located in the United Kingdom and Republic of Ireland (“Customers”) and starts on 01.03.2021 and will continue up to and including 30.04.21 (“Promotional Period”).

  3. Subject to the remainder of these terms, Customers will receive a £5/€5 rebate for every new VisionXtra patient registration at VisionXtra www.ecommerce.coopervision.com/CvOptions/CvoViewOrders.aspx  (“New Patient”) and subsequent  purchase of a minimum of 6 boxes of 30 x daily disposable contact lenses (Biomedics® 1 day, clariti® 1 day, Live®, MyDay® and Proclear® 1 day daily disposable family, but excluding MiSight 1 day), or 2 boxes of 3 x monthly replacement contact lenses (Avaira VitalityTM Biofinity®, Biomedics®, clariti® or Proclear® monthly family) (“Products”) for direct delivery to the home of the New Patient, during the Promotional Period. Figures quoted in £ apply to UK customers, figures quoted in € apply to ROI customers.

  4. The supply and delivery of the Products will be in accordance with CooperVision’s standard terms of business or, if applicable, the terms of the supply agreement between CooperVision and the Customer.

  5. For the purposes of this Promotion, a New Patient means a patient of the Customer that has not previously been registered on CooperVision’s VisionXtra patient registration scheme

  6. Only one rebate may be claimed in relation to a particular New Patient irrespective of the number of orders made on their behalf.

  7. Rebates will be paid, by way of a credit to the Customer’s CooperVision account, within 5 months of the end of the Promotional Period (i.e. by 30 September 2021).

  8. Payment of the rebates will be dependent on Customers having no overdue invoices under its account with CooperVision and compliance with these terms and conditions. This rebate offer may not be combined with any other CooperVision offers. Customers acknowledge the nature and limitations of the internet and CooperVision accepts no liability for any failure or delay in registering a New Patient to VisionXtra, resulting from the Customer’s connection to the internet or any technical malfunction. If there is any reason to believe that there has been a breach of these terms and conditions, CooperVision may, at its sole discretion, reserve the right to exclude the Customer from participating in the Promotion.

  9. CooperVision reserves the right to review or revise these terms and conditions at any time without notice. CooperVision also reserves the right to suspend, cancel, amend or withdraw the Promotion in whole or in part, in its sole discretion, if it believes the Promotion is not capable of being conducted as specified in these terms and conditions or in the event of a virus, computer bug, or unauthorised human intervention or any other cause that is beyond the reasonable control of CooperVision that could corrupt or affect the affect the administration, security or normal course of the Promotion. Neither CooperVision nor any of its subsidiary or affiliated companies are responsible for any condition, circumstances, losses, failures, or delays caused by events beyond its or their control that may cause the Promotion to be disrupted or corrupted. Save where it has been negligent, CooperVision will not be responsible for any damage (whether material or non-material), or for technical, hardware or software failures, lost, faulty or unavailable network connections or difficulties of any kind that may limit or prohibit the Customer’s ability to participate in the Promotion. Nothing in these terms and conditions shall in any way limit CooperVision’s liability for death or personal injury caused by its negligence or for any other matter where liability may not as a matter of law be limited at any time.

  10. Only orders placed directly by the Customer are eligible; orders placed by distributors, wholesalers or other third parties on behalf of the Customer do not qualify.

  11. Orders that are subsequently cancelled and refunded will not be eligible for a rebate.

  12. Orders shall be placed via the CooperVision VisionXtra website.

  15. These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
